General terms and conditions.
Article 1. Definitions
1.1 Zoef Robot: brand and trade name used by Zoef Robot B.V. for legal acts and entering into Agreements, to which these General Terms and Conditions apply.
1.2 Zoef Robot is an online store for household robots, which can be visited via www.ZoefRobot.nl, and is wholly owned by Zoef Robot B.V. The following conditions apply to all products and services supplied to consumers via www.ZoefRobot.nl.
Article 2. Applicability
2.1 These General Terms and Conditions of Sale apply exclusively to all offers, orders, and agreements concluded using the websites of Zoef Robot, to the exclusion of any other general terms and conditions.
2.2 Accepting an offer or placing an order implies acceptance of the applicability of these Terms and Conditions.
2.3 Deviations from the provisions in these Terms and Conditions can only be made in writing. If a part of these General Terms and Conditions is deviated from, the remaining provisions remain fully in force.
2.4 All rights and claims, as stipulated in these Terms and Conditions and in any further agreements for the benefit of Zoef Robot, are equally stipulated for the benefit of intermediaries and other third parties engaged by Zoef Robot.
Article 3. Agreements
3.1 An agreement is concluded after the customer accepts the offer on our website. Zoef Robot is entitled to refuse orders or request additional information. If an order is not accepted, the customer will be informed of the reason.
Article 4. Prices
4.1 The prices stated for the articles are in euros, including VAT. Shipping costs are (unless otherwise stated) not included in the stated prices. Before the conclusion of the agreement, the total price including shipping costs will be communicated via our website.
4.2 The shipping costs for orders within the Netherlands and Belgium are €6.95. For shipments to countries other than the Netherlands or Belgium, the contribution to the shipping costs depends on the country concerned.
4.3 Zoef Robot cannot be held to price indications that are evidently incorrect, for example, due to obvious input, typesetting, or printing errors. No rights can be derived from unlawful price information.
Article 5. Payments
5.1 Payment can be made in one or more of the ways indicated during the ordering process. Further (payment/order) conditions may be imposed on a customer's order. After placing an order, the customer will immediately receive a confirmation containing the total costs, including shipping costs. Payment is always made entirely in advance.
5.2 Payment is possible by:
a) Payment in advance by bank or giro transfer. This payment must be received in full by Zoef Robot within 7 days of the order date, after which the order will be shipped.
b) Payment by Ideal / Bankcontact / Google Pay / Apple Pay / Visa / Mastercard / American Express and Shop Pay, after receipt of payment in Zoef Robot's account, the order will be prepared for shipment.
5.3 The customer authorizes Zoef Robot to perform all actions necessary to facilitate payment in the payment method chosen by the customer.
5.4 For payment by bank or giro, the date of payment is the date of crediting of Zoef Robot's giro or bank account.
Article 6. Delivery/Shipment
6.1 Zoef Robot aims to offer orders for shipment within 2 working days after receipt of payment. However, Zoef Robot is not obliged to do so.
We will inform you about the shipment of your package and provide you with the Track & Trace information. The shipping time for your package is usually 2 to 3 working days.
6.2 The maximum delivery period is 30 days after placing the order, with the exception of orders where the customer has indicated that they wish to receive them later or for pre-sale orders. If it proves impossible to deliver an order within 30 days, the customer will be informed in good time and has the right to cancel their order free of charge.
6.3 Shipping orders within the Netherlands and Belgium is free, provided the total amount of your order exceeds €100. If you order for less, we will have to charge €6.95 for shipping. Your package will be shipped at your own risk, but special care is given to protecting fragile objects. For other countries, the full shipping costs are at the customer's expense.
6.4 An order will not be shipped by us if it cannot be shipped completely, unless consultation with the customer has taken place. If delivery is delayed either due to (temporary) unavailability or for other reasons, or if an order cannot be executed or can only be executed partially, the customer will receive notification thereof no later than seven (7) working days after placing the order. In that case, the customer has the right to cancel the order free of charge. Zoef Robot will then arrange for a refund.
6.5 Deviations in color, type, text and/or price changes reserved. Offered goods and/or services are clearly and truthfully depicted and/or described and as completely as reasonably required.
Article 7. Retention of Title
The ownership of delivered products only transfers when the customer has paid all that the customer owes to Zoef Robot on the basis of the agreement(s) concluded regarding the delivered products.
Article 8. Returning and exchanging items
It is, of course, possible that you wish to reconsider your purchase decision. After purchasing an item in our webshop, you therefore have the option to dissolve the agreement without stating reasons, within 14 days. In practice, this means that after you have received your item, you have 14 days to reconsider and dissolve the agreement. You do not need to give a reason for this. You then have 14 days to return the product. However, it is very important that you return the item and all supplied accessories – if reasonably possible – in their original condition, unopened and undamaged in the original packaging. If this is not the case, we will charge costs for this.

After registering the return, we will refund the order amount including shipping costs within a maximum of 14 days, provided the aforementioned return has been received in good order. Costs for returning the item are at your own expense.
If you wish to return the item because it is damaged and/or defective upon receipt, it is important that you inform us as soon as possible.
Items purchased through Zoef Robot can be exchanged and/or returned without stating reasons. We kindly request you to observe the following instructions when returning the item:
- Fill in the online return form completely here.
- You return the item within 14 days to the address stated on the return form.
- The costs for returning are at your expense. We have covered the shipping costs to you.
- You must send the item – if reasonably possible – in its original condition and packaging and undamaged.
- The item is complete and without signs of use.
- The item also includes all supplied accessories and any extras.
- You must include your proof of purchase (invoice).
- You may only try out the item on the condition that no signs of use and/or damage occur.
- If there is a reduction in value due to damage, this reduction in value can be charged to you as a consumer.
8.2 The customer is obliged to send the items to be returned at their own expense, this can be sent by post, (The items to be returned) must at all times be sufficiently stamped, insufficiently stamped returns will NOT be accepted and therefore NOT credited.
Article 9. Complaints
Complaint regarding delivery of your order
9.1 We do everything we can to deliver a perfect product. Upon receipt of your order, you must immediately inspect the delivered goods and report any defects found immediately in writing. Should a product not be delivered in accordance with your order or not meet the description on our website, you must report this to us immediately. This can be done by contacting us by telephone or sending an e-mail to service@zoefrobot.nl.
Should the offered solution not meet your expectations, you can cancel the entire order within 14 working days, without additional costs. The already paid amount will be credited immediately, taking into account what is described in Article 8.
9.2 Of course, it can happen that the quality of a product after a period of use no longer meets your expectations.
The warranty period on the robots is 2 years.
We care about our products and logically do our best to deliver them to you in top condition. Nevertheless, it sometimes happens that an order breaks during transport or that something else happens that allows you to claim warranty. Legally, you are obliged to report the defect to us within two months of discovering it. If the defect falls within the warranty, we will arrange for repair or replacement free of charge.
The warranty period on the robots is two (2) years after receipt of the product, with the exception of the conditions mentioned below, from the date of purchase (the 'warranty period') will be free from material and manufacturing defects.
In the event that the product does not meet the warranty standard, we will repair or replace the product free of charge within a commercially reasonable period as described below.
WHAT IS NOT COVERED?
(1) This limited warranty does not apply to batteries, accessories or other consumables, such as filters, brushes, dust bags, blades, cleaning cloths or cleaning solutions.
(2) Unless otherwise agreed in writing, the limited warranty does not apply if the defect or defects are related to:
(a) normal wear and tear,
(b) defects caused by rough or incorrect handling or use or damage caused by accidents, misuse, neglect, fire, water, lightning or other natural disasters,
(c) non-compliance with the product instructions,
(d) intentional damage, neglect or negligence,
(e) use of spare parts, an unauthorized cleaning agent if applicable, or other replacement parts (including consumables) not supplied or recommended by us,
(f) alterations or modifications to the product carried out by you or an unauthorized third party,
(g) inadequate packaging of the product for transport,
(h) extreme or external causes beyond our reasonable control, including failures, fluctuations or interruptions in the power supply, the internet service of the internet provider or wireless networks, or
(i) weak and/or inconsistent signal strength in your home.
(3) This limited warranty is not valid if (a) the product's serial number has been removed, erased, damaged, altered or rendered illegible in any way (as determined at our discretion) or (b) you violate the terms of this limited warranty or your contract with us.
(4) This warranty expires if you have attempted to repair the defect yourself without consultation and/or have not followed the user manual and/or operating instructions.
9.3 Except in cases of gross negligence and/or intent on the part of Zoef Robot BV, all liability of Zoef Robot BV is limited to the maximum amount of the invoice price of the defective (part of the) Product that caused the damage. If you have such a complaint about an item you purchased from us, we would like to hear from you. You can contact us by telephone on working days between 09:00 and 17:00 or send an email to service@zoefrobot.nl.
9.4 For returning an item under a warranty claim, the customer can request a shipping label. If the customer chooses to return the item themselves, the shipping costs can be reimbursed under the following conditions:
- The complaint falls within the statutory warranty period of 2 years.
- The complaint is declared valid after assessment by Zoef Robot.

Shipping costs will be reimbursed up to a maximum of:
- €6.95 for returns within the Netherlands
- €11.95 for returns from abroad
If the above conditions are met, the shipping costs will be credited retrospectively to the customer.
We will resolve the problem as soon as possible in consultation with you. In order to ensure smooth handling of your complaint, we ask you to strictly follow our instructions.
9.4 We recommend that you first make complaints known to us by emailing info@zoefrobot.nl. If this does not lead to a solution, it is possible to register your dispute for mediation via WebwinkelKeur. From February 15, 2016, it is also possible for consumers in the EU to register complaints via the ODR platform of the European Commission. This ODR platform can be found at http://ec.europa.eu/odr. If your complaint is not yet being handled elsewhere, you are free to submit your complaint via the platform of the European Union."
Article 10. Cancellation of your order
10.1 Any order can be cancelled, without payment of a penalty and without stating reasons, provided it has not yet been shipped, within 24 hours after you have placed the order. We request you to send an e-mail to service@Zoef Robot.nl. Your order cancellation will be confirmed by e-mail. As soon as your cancellation request has been confirmed by us, you may consider it received. If you have already paid for your cancelled order, Zoef Robot will refund the paid amount within fourteen (14) days at the latest.
10.2 The buyer has, in accordance with the Distance Selling Act, the right to revoke (cancel) the order within fourteen working days after receipt (only the entire) order, without payment of a penalty and without stating reasons. The buyer also has the option to have the order amount, if already paid, refunded. In this case, Zoef Robot does not charge costs for shipping to the delivery address of items in this way, however, the customer is obliged to return the order at their own expense.
10.3 To do this, you must contact zoefrobot@outlook.com within 14 working days of receipt at the delivery address.
In this e-mail, you must state your name, order number and (if applicable) your bank details. You also indicate that you wish to cancel your order in accordance with the Distance Selling Act. Provided your request meets the above, you will receive a confirmation within 7 working days with the address to which you can return your order. See also the procedure in Article 8.1
10.4 You will receive a confirmation by e-mail as soon as we have received and processed your shipment. If paid, a refund of the full order amount will take place no later than fourteen (14) days after confirmation of receipt of your order by Zoef Robot.
10.5 For business orders, however, there is no cooling-off period for the ordered items. Nevertheless, we strive to investigate the possibility of taking back the products on a goodwill basis. We will make a credit proposal based on 'restocking costs'. These costs vary based on the turnover rate of the product and the other costs that must be incurred to make the product resalable.
Article 11. Orders/communication
Zoef Robot is not liable for misunderstandings, mutilations, delays or improper transmission of orders and communications as a result of the use of the internet or any other means of communication in the traffic between the customer and Zoef Robot, or between Zoef Robot and third parties, insofar as it relates to the relationship between the customer and Zoef Robot, unless and insofar as there may be intent or conscious recklessness on the part of Zoef Robot.
Article 12. Force Majeure
In case of force majeure, Zoef Robot has the right, at its own discretion, to suspend the execution of a customer's order, or to dissolve the agreement without judicial intervention, by notifying the customer in writing, and without Zoef Robot being obliged to pay any compensation, unless this would be unacceptable in the given circumstances according to standards of reasonableness and fairness.
Article 13. Applicable law and competent court
13.1 Dutch law applies exclusively to all rights, obligations, offers, orders and agreements to which these Terms and Conditions apply, as well as to these Terms and Conditions.
13.2 Disputes between parties can be submitted to the competent court in the Netherlands.
13.3 If one or more articles of these terms and conditions are declared invalid by judicial decision:

the remaining provisions of these general terms and conditions will remain fully in force,

Zoef Robot and the client will consult in order to agree on new provisions to replace the void or annulled provisions, whereby the purpose and intent of the void or annulled provisions will be observed as much as possible.

It may happen that you are not satisfied with our products or services. Please contact us as soon as possible, preferably by e-mail via: service@zoefrobot.nl. We will respond to your complaint within 30 days at the latest.
